Petitions Briefings

Welcome to the Petitions Briefings area of the Scottish Parliament's website

Petitions briefings are written by research specialists in the Scottish Parliament Information Centre (SPICe). They are intended primarily for use by the members and clerking staff of the Public Petitions Committee (PPC) in the Committee’s consideration of petitions submitted to the Parliament.  The briefings are also available to the members and clerking staff of any parliamentary committee to which petitions are referred by the PPC.

Petitions briefings provide a brief background to the subject matter of the petition and give an overview of the main issues with which the petition is concerned.   Petitions briefings do not attempt to assess the merits, or otherwise, of a petition but are intended to help the PPC and other committees to make an informed decision on the handling of the petition.

PE1338 Petition on Concessionary Travel on Night Bus Services (91KB pdf)

Calls on the Parliament to urge the Scottish Government to amend relevant legislation to provide that night services are eligible services for holders of entitlement cards for free bus travel for older and disabled persons.

Calls on the Parliament to urge the Scottish Government to ensure that the new specialist deaths unit being created by the Crown Office and Procurator Fiscal Service is able to investigate retrospective and current cases of suspicious deaths, including after a Fatal Accident Inquiry has taken place, where the bereaved can reasonably demonstrate that the circumstances of the death were suspicious and that there is a robust and open mechanism, involving the families, for an independent review of such suspicious deaths

PE1329 Petition on Public Guardians Responsibilities Under the Adults With Incapacity (Scotland) Act 2000 (94KB pdf)

Calls on the Parliament to urge the Scottish Government to put in place a review of the Adults with Incapacity (Scotland) Act 2000 with a remit to bring it up to date, specifically to introduce legislation that will cover the area surrounding deceased adults and in particular the role of the Public Guardian in these cases.

PE1319 Petition on Improving Youth Football in Scotland (117KB pdf)

Calls on the Parliament to urge the Scottish Government to investigate the (1) legal status and appropriateness of professional SFA clubs entering into contracts with children under 16 years; (2) audit process and accountability of all public funds distributed by the Scottish Football Association to its member clubs; (3) social, educational and psychological effects and legality of SFA member clubs prohibiting such children from participating in extra curricular activity; and (4) appropriateness of ‘compensation’ payments between SFA member clubs for the transfer of young players under the age of 16 years; and to (5) increase the educational target from two hours curricular physical activity to four hours per week; and (6) develop a long-term plan to provide quality artificial surfaces for training and playing football at all ages across all regions

Calls on the Parliament to urge the Scottish Government to amend Planning Circular 3/2009, Notification of Planning Applications to (a) require that Scottish Ministers are notified of any planning application a planning authority is minded to approve where there is an outstanding objection from another planning authority (b) widen the definition of “national significance” used by Ministers in deciding whether to call-in an application to include objections by a planning authority to a major development for which another authority are minded to grant consent.

Calls on the Parliament to urge the Scottish Government to make representations to the UK Government asking it to investigate the circumstances into the process for awarding medals to those involved in the 1949 Yangtze campaign and, in particular, whether this process was corrupted as a result of the exclusion of relevant and important documents relating to the role of HMS Concord in the Yangtze Campaign on 30 and 31 July 1949.

Calls on the Parliament to urge the Scottish Government to review the arrangements which allow individuals who have undergone satisfactory police checks but who do not have a national governing body level 2 coaching certificate to access community resources (funding as well as sports facilities and equipment) in the same way as those who do have such a qualification in order to increase the breadth and number of coaches available to work with young people across the range of sports activities.

Calls on the Parliament to urge the Scottish Government to amend the Mental Health (Care and Treatment) (Scotland) Act 2003 to abolish the over-use of Compulsory Treatment Orders for non-violent mentally ill patients and to provide a process which allows patients and their representatives to challenge any perceived errors in CTO reports which can lead to misdiagnoses, faulty speculation and the administration of unwarranted forms of treatment.

Calls on the Parliament to urge the Scottish Government to restore access to justice for all by abandoning its policy of full withdrawal of public funding for civil courts and repealing the Orders relating to Court of Session, High Court of Judiciary, Public Guardian and Sheriff Court fees which increase the cost to individuals in accessing civil justice.
